The Lucknow Bench of the Allahabad Excessive Court docket has refused to quash an FIR lodged in opposition to Alt Information co-founder Mohammed Zubair for calling Hindu seers Yati Narsinghanand Saraswati, Bajrang Muni and Anand Swaroop “hate mongers” on Twitter.
Dismissing his plea, the holiday bench of Justices Ramesh Sinha and Ajay Kumar Srivastava noticed, “The perusal of the file makes out, prima facie, offences in opposition to the petitioner at this stage and there seems to be a enough floor for investigation within the case.” An FIR was lodged in opposition to the fact-checking web site co-founder on June 1 underneath Part 295 (A) of the IPC and Part 67 of the IT Act on the Khairabad police station in Sitapur district for intentionally “outraging spiritual emotions” of the seers.
Zubair challenged the FIR, pleading that his tweet didn’t insult or tried to insult spiritual beliefs of a category and the case has been lodged simply to trigger “harassment”.
Opposing his petition, the state counsel argued that Zubair is a recurring offender, who has 4 legal circumstances registered in opposition to him.
